Acceptance of Responsibility and Agreed Resolution Process

During an Initial Meeting, the Administrative Hearing Officer may provide a referred student with the option of an Acceptance of Responsibility and Agreed Resolution if the case is appropriate for resolution under this process. If a referred student accepts this option, they and the Administrative Hearing Officer would collaborate on identifying appropriate outcomes, including sanctions, related to the violation of the Code of Student Responsibility. The student would receive the decision during the Initial meeting after completing the Acceptance of Responsibility and Agreed Resolution form with the Administrative Hearing Officer. Outcomes within an Agreed Resolution may include educational projects, including alcohol or other drug interventions,  probation, restitution, restriction, or university reprimand.   1. While cases are determined on a case by case basis, the Acceptance of Responsibility and Agreed Resolution Process could replace an Administrative Hearing in cases that met the following criteria:
    1. Alleged behavior does not rise to the level of conduct that if found in violation, could result in suspension or dismissal from the University and is not alleged behavior that would be resolved within the Formal Title IX Sexual Harassment Policy and Procedures, Sexual and Relationship Violence or Anti-Discrimination and Anti-Harassment Policy.
    2. Student is not currently on probation from a prior finding of in violation of the Code of Student Responsibility.
    3. Student has not previously been found in violation of the same policy.
    4. Student must accept responsibility, including acknowledging their conduct and the impact on community and
    5. Student must elect that they would prefer to engage in an Agreed Resolution instead of an Administrative Hearing.

The Acceptance of Responsibility and Agreed Resolution option will be offered to referred students as a resolution option instead of an Administrative Hearing. If offered as an option, the referred student may choose between an Administrative Hearing or an Acceptance of Responsibility and Agreed Resolution. If the referred student and Administrative Hearing officer cannot come to an agreed resolution, the case will be resolved as an Administrative Hearing instead.
